Driver Agreement and Plans

Effective November 15, 2026. Last updated November 7, 2026. Applies to Oak Ride, Oak Driver and Oak Drop, operated by ICE Innovations Inc. iChef has its own terms at ichef.co.

This agreement applies to everyone who drives for Oak Ride or carries deliveries for Oak Drop, in addition to the Terms of Service. When we say "driver" we mean both.

1. You are an independent business

You are an independent contractor, not an employee of ICE Innovations Inc. You decide when to go online, which offers to accept, and how to run your work. You supply your own vehicle, phone, fuel, insurance and maintenance. Oak sets safety standards and provides the platform; Oak does not set your hours or require minimum trips. Nothing here creates an employment, partnership or agency relationship. You may drive for other platforms.

2. Eligibility

You must meet and continue to meet every requirement in Safety and Driver Standards, including the background check, which is rerun annually and on report. Tell us within 48 hours of any change that affects eligibility: a license suspension, an accident that damages the vehicle, a change of vehicle or insurance, or a criminal charge.

3. Plans and what you keep

You choose a monthly plan in the app. The plan sets the commission Oak keeps from each fare you complete. Commission is calculated on the agreed fare, excluding tips, tolls and airport fees, which pass to you in full.

Bronze$4920%Above standard
Silver$14910%High
Gold$2990%Highest
  • Plan fees bill monthly in advance to your payment method, or are deducted from your payouts if you choose that in the app.
  • You can move up a plan at any time; the new rate applies immediately and the fee is prorated. You can move down effective your next billing date.
  • Plan fees are not refunded for partial months, except where the account is closed by Oak for a reason other than your conduct, in which case the unused portion is refunded.
  • Matching priority means that when several drivers are equally placed for an offer, higher plans see it first. It never overrides distance or rider preferences such as the women driver preference.
  • Current plan prices are always the ones shown in the app. If we change a price, you get 30 days notice and may cancel before it applies.

4. Accepting offers and completing rides

Every offer shows the pickup area, the proposed fare and your exact take home at your plan. You may accept, counter, or ignore any offer; acceptance rate does not affect your plan or standing. Once you accept and the rider confirms, you are committed to that ride at that fare. Cancelling after acceptance is covered in Cancellations and Refunds. You must follow the route the rider reasonably requests or the app's suggested route, not take passengers who are not part of the booking, and not ask the rider to pay outside the app.

5. Payouts

Earnings are paid through Stripe Connect to the bank account you register. Standard payouts run weekly on Tuesday for the prior Monday to Sunday. Instant payouts are available in the app for the fee shown there. You can see every fare, commission, tip and fee line in the earnings screen, and dispute any line within 30 days. Oak may hold or reverse a payout where there is evidence of fraud, a chargeback, or a pending safety investigation, and will tell you why.

6. Tips

100% of every tip goes to you. Tips are not subject to commission or plan fees. You may not solicit tips in exchange for a lower fare, better rating or any other favor.

7. Taxes

You are responsible for your own taxes. Oak does not withhold income tax. If your payments through the platform meet the IRS reporting threshold for the year, Oak (through its payment processor) will issue you a Form 1099 by January 31 of the following year, and the same information is reported to the IRS. Keep your legal name, address and taxpayer identification number current in the app so the form is correct. Your plan fees, mileage and vehicle costs may be deductible business expenses; ask a tax professional.

8. Insurance

You must carry personal auto insurance that meets North Carolina minimums at all times. Oak's commercial policy applies during the periods described in Safety and Driver Standards. Report any accident while online to Oak within 24 hours, and to the police where the law requires it.

9. Using the apps

Only you may use your driver account. Do not share it, let someone else drive under it, or drive a vehicle that is not registered to your account. Keep the Oak Driver app running while online so the demand map, matching and safety features work. While online and available the app sends your location every few seconds; it stops when you go offline.

10. Standing, warnings and deactivation

We may pause or deactivate a driver account for: a failed or lapsed background check; a safety complaint we substantiate after review; a rating below 4.6 after at least 50 rated rides and a written warning with 30 days to improve; fraud, including fake rides or referral abuse; driving under the influence; discrimination or harassment; or repeated cancellations after acceptance. Before a permanent deactivation other than for safety or fraud, we tell you the reason and you can respond within 7 days. You can appeal any deactivation to support@oakrides.com; a different person than the one who made the decision reviews it.

11. Ending this agreement

You may stop driving at any time. Close the account in the app or email us; your final payout is sent on the next regular cycle and any prepaid plan month is handled under section 3. Oak may end this agreement with 14 days notice without cause, or immediately for the reasons in section 10.

12. Disputes

Disputes under this agreement follow Dispute Resolution and Arbitration.
